Consumer Health Data Privacy Policy

General Privacy Policy

This policy applies to consumer health data and exists separately from our general Privacy Policy. It is provided under the Washington My Health My Data Act and applies to residents of Washington State; we apply it to all users in the United States.

Dzeny is operated by PHOENIX PATENT AND INTELLECTUAL PROPERTY RIGHTS MANAGEMENT, LLC. Dzeny is a mental wellbeing application. It is not a healthcare provider, and it does not provide medical diagnosis or treatment.

What consumer health data we collect

We collect only what our features need:

  • Data you tell us. What you write in conversations with your Dzeny assistant, the results of in-app tests and check-ins, your stated goals and how you feel.
  • Data from connected devices, only if you connect one. Sleep, heart rate variability, resting heart rate, and physical activity — read from Apple Health, Health Connect, or a device you link directly.
  • Data derived from the above. Your mental state index and the recommendations built on it.

We do not collect precise location, biometric identifiers, genetic data, or information about reproductive or sexual health.

Where it comes from

Directly from you; from your device with your permission; and from ROOK, which normalizes data from wearables on our behalf.

Why we collect it

  • to calculate your personal mental state index and show it to you;
  • to personalize conversations, recommendations and exercises inside the app;
  • to keep the service working and secure.

We do not use consumer health data for advertising or marketing, we do not use it to build advertising audiences, and we do not use it to make decisions about credit, insurance, employment, or housing.

Who we share it with

We do not sell consumer health data. We have never sold it, and selling it would require your separate written authorization, which we do not seek.

We share it only with service providers that process it on our behalf, under contract, and only for the purposes above:

We do not share consumer health data with advertising partners, data brokers, or analytics products used for advertising.

We may disclose data if the law requires it, or to protect someone's safety.

Your rights

You can:

  • confirm whether we collect, share, or sell your consumer health data, and access it;
  • withdraw consent to collection and to sharing;
  • delete your consumer health data.

Deleting your account deletes the health data with it. You can also delete only your health data and keep your account. If you connected a device, you can disconnect it at any time in the app or in your phone settings; we stop receiving new data immediately.

To exercise any of these, write to support@dzeny.com. We answer within 45 days and may ask for information needed to confirm it is your account.

If we deny your request, you may appeal by replying to our answer. If the appeal is denied, you may contact the Washington State Attorney General at https://www.atg.wa.gov/file-complaint

Changes

If we start collecting a new category of consumer health data, or start using existing data for a new purpose, we will update this policy and ask for your consent before the change takes effect.
